EPA has withdrawn two controversial draft TSCA proposals that have been held up by OMB for a long time (well past the 90 day limit OMB is supposed have):

  • Chemicals of Concern designation under TSCA 5(b)(4) for BPA, some phthalates and polybrominated diphenyl ethers drafted back in 2010. Withdrawn because they have a new work plan to deal with such chemicals.  Assessments have been done on several chemicals and are out for comment.
  • "Clarification" that health and safety studies submitted with PMNs could not hold chemical identity confidential.in 2011.  Withdrawn because it might discourage such studies from being done.
